Welcome to Zilo Care ("Platform"). These Terms & Conditions ("Terms") govern your access and use of our services, including online appointment booking, patient and healthcare data management, digital prescription management, front desk software, payments and billing, queue management, and staff access management. By accessing or using the Platform, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By using our Platform, you agree to these Terms and any amendments or updates that may be made from time to time. If you do not agree to these Terms, please refrain from using the Platform.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are of legal age and have the legal capacity to enter into these Terms under Indian law.

3. Platform Services

Our Platform offers the following services:

  • Online Appointment Booking: Users can schedule appointments with healthcare providers through our Platform.
  • Patient & Healthcare Data Management: The Platform enables the management of patient records, including medical history, lab results, and other healthcare data, in compliance with Indian laws such as the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
  • Digital Prescription Management: Healthcare providers can issue and manage digital prescriptions for patients through the Platform.
  • Front Desk Software: The Platform provides tools for managing front desk operations, including patient check-ins, scheduling, and communication.
  • Payments & Billing: The Platform facilitates payments and billing for healthcare services, supporting various payment methods including UPI, credit/debit cards, and net banking.
  • Queue Management: The Platform allows for efficient management of patient queues in healthcare facilities.
  • Staff Access Management: The Platform offers tools to manage access to various features and data for healthcare staff based on their roles and responsibilities.

4. User Responsibilities

Accurate Information: You agree to provide accurate and complete information when using the Platform. It is your responsibility to keep your information up-to-date.

Confidentiality: You are responsible for maintaining the confidentiality of your account information, including your mobile number and OTP (One-Time Password).

Compliance with Laws: You agree to comply with all applicable laws and regulations of India, including health privacy laws such as the Clinical Establishments (Registration and Regulation) Act, 2010, and the Information Technology Act, 2000.

5. Authentication

Mobile Number & OTP: Authentication on the Platform is conducted using your mobile number and a One-Time Password (OTP) sent via SMS. This OTP is used to verify your identity each time you log in.

Security: You must ensure that your mobile number is secure and not shared with unauthorized persons. If you suspect that your OTP has been compromised, please contact us immediately.

Responsibility: You are responsible for all activities conducted through your account once authenticated using your mobile number and OTP.

6. Privacy Policy

Your use of the Platform is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information in compliance with Indian laws. Please review our Privacy Policy to understand our practices.

7. Data Security

We take the security of your data seriously and implement appropriate measures to protect it. However, no system is completely secure, and we cannot guarantee the absolute security of your data. Our practices are in line with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

8. Digital Prescriptions

Authorization: Only licensed healthcare providers registered with the Medical Council of India (MCI) or relevant state medical councils may issue digital prescriptions through the Platform.

Compliance: Users must comply with all applicable laws and regulations, including the Drugs and Cosmetics Act, 1940, and the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.

Responsibility: The accuracy and appropriateness of any digital prescription issued through the Platform are the sole responsibility of the healthcare provider.

9. Payments & Billing

Payment Methods: The Platform supports multiple payment methods, including UPI, credit/debit cards, and net banking. All transactions are processed in Indian Rupees (INR).

Billing: Users are responsible for ensuring that all payments and billings are accurate and comply with applicable Indian tax laws, including GST.

10. Queue Management

Efficient Service: The Platform offers tools for managing patient queues, aiming to improve efficiency and reduce waiting times. Users are expected to adhere to the queue management protocols set by healthcare providers.

11. Staff Access Management

Role-Based Access: Access to various features and data on the Platform is managed based on the roles and responsibilities of healthcare staff. Administrators are responsible for assigning and managing access levels.

Confidentiality: Staff members must adhere to confidentiality and data protection protocols in accordance with Indian laws.

12. Limitation of Liability

No Medical Advice: The Platform is not intended to provide medical advice, diagnosis, or treatment. All healthcare decisions should be made in consultation with a qualified healthcare provider.

Service Availability: We do not guarantee that the Platform will be available at all times or that it will be free from errors. We reserve the right to modify, suspend, or discontinue the Platform at any time without notice.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zilo Care, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Platform.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of those changes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [Hyderabad, India].
